Scott H. Bernstein specializes in bankruptcy, reorganization and commercial litigation. His practice includes both in-court and out-of-court restructurings and the rehabilitation of financially distressed businesses. Mr. Bernstein has represented corporate debtors, chapter 7 and 11 trustees, committees, financial institutions and private equity funds that are lenders and investors in financially troubled companies, buyers and sellers of distressed businesses, parties seeking to invest in and/or acquire the assets and businesses of financially troubled companies, and secured and unsecured creditors. He has represented court-appointed receivers and has extensive experience in the area of commercial litigation in Federal and State Courts. Mr. Bernstein frequently acts as local counsel for out-of-state firms seeking competent, knowledgeable New Jersey, New York and Connecticut counsel, and as bankruptcy co-counsel to boutique firms.
A frequent speaker and writer on bankruptcy-related topics, Mr. Bernstein has been published by the American Bankruptcy Institute Journal, New Jersey Law Journal, New York Law Journal, New York Business Law Journal, Real Estate Weekly, Law360 and Dow Jones DBR Small Cap. He is a contributing author to A Practitioner's Guide to Prepackaged Bankruptcy: A Primer, which is published by the American Bankruptcy Institute. From the Fall of 2002 through the Summer of 2003, Mr. Bernstein served as a law clerk to the Honorable Robert E. Gerber of the United States Bankruptcy Court for the Southern District of New York.
Mr. Bernstein was named 2009, 2010 and 2011 Empire State Counsel by the New York State Bar Association for his contribution to pro bono clients. He is also a recipient of The Legal Aid Society's 2010 and 2011 Pro Bono Publico Awards for outstanding service to The Legal Aid Society and its clients.
