A large national retailer found itself defending against a high-profile class action alleging violations of a consumer protection statute. While other retailers settled cases, our client decided to fight back. Eric Neyman developed an aggressive, two-pronged defense, comprising a short-term solution of moving to dismiss the class action for failing to allege a real injury, and a long-term solution of working to change the regulatory and legislative landscape that gave rise to these types of suits. The class action case was dismissed, and regulators have taken steps to modify the retailer requirements that gave rise to abusive lawsuits.
