Mr. O'Shaughnessy is a trial lawyer, concentrating on complex litigation of all kinds, including antitrust, intellectual property litigation, class action defense, unfair competition and contract disputes.  He regularly appears at the trial and appellate levels of the federal and state courts, both in and out of New Jersey, and has been chief counsel in domestic and international arbitrations.

He currently handles or has handled a wide variety of antitrust cases in New Jersey and elsewhere, involving price-fixing, group boycott, monopolization, resale price maintenance and price discrimination claims.

Mr. O'Shaughnessy has been recognized as a New Jersey Super Lawyer since inception and in Best Lawyers for the last 18 years.  He has also been recognized by Chambers USA as a “Senior Statesman” for General Commercial Litigation in New Jersey.

Representative Matters

Obtained summary judgment dismissal of a putative class action against an NFL team challenging its personal seat license program for a new stadium.
Co-counsel for NCAA and the major professional sports leagues in obtaining injunctions against implementation of New Jersey’s Sports Wagering Law in violation of the Federal Professional and Amateur Sports Protection Act.
Co-counsel in defending biopharmaceutical companies in three separate “pay for delay” class actions arising set of settlements of Hatch-Waxman patent infringement actions.
Successfully defended two partners of major law firms against charges of federal RICO violations and conspiracy to defame an electronics distributor.
Extensive experience, as co-counsel, in representing brand pharmaceutical companies in all aspects of Hatch-Waxman patent infringement litigation.
