Mr. Thomen is a Partner in the Product Liability Group of McCarter & English, LLP. He is an experienced trial lawyer with a diverse complex civil litigation practice. Mr. Thomen has extensive experience litigating and counseling clients in the areas of product liability, construction, business disputes, personal injury and real property. He is experienced in all phases of trial and litigation in state and federal courts throughout the United States as well as in arbitrations and mediations. In addition to his trial experience, Mr. Thomen has handled all aspects of appellate practice, including cases before the United States Supreme Court and various federal and state appellate courts.

Mr. Thomen’s product liability experience includes an emphasis on the defense of claims against manufacturers of consumer products, commercial and industrial equipment. He represents companies before the Consumer Product Safety Commission in connection with product recalls and reporting activities, and has successfully negotiated with the CPSC to narrow the scope of several voluntary recalls involving a wide range of products.  Mr. Thomen has also advised clients on the Consumer Product Safety Improvement Act, the Virginia Graeme Baker Pool and Spa Safety Act, the Federal Hazardous Substances Act, and the Flammable Fabrics Act, and has become a leading expert on the CPSC’s consumer safety complaint database—www.SaferProducts.gov. He regularly advises product manufacturers on FTC regulations and warning, labeling, guarantee and warranty issues, and has drafted warnings, warranties, guarantees, product instructions for dozens of consumer goods companies and other aspects of risk management.

Mr. Thomen also represents manufacturers of consumer goods, pharmaceutical drugs, medical devices and asbestos-containing products in cases throughout the country. He has handled complex personal injury suits involving alleged catastrophic injuries, wrongful death and survivorship claims. Mr. Thomen practices throughout New England and has managed product liability litigation for companies on a national level.

On behalf of construction industry clients, Mr. Thomen has prosecuted and defended a wide array of significant claims involving alleged construction defect, construction accidents and contractual disputes. In the real property context, he has prosecuted commercial and complex residential foreclosure actions on behalf of financial institutions and other entities.

Mr. Thomen was recognized in the Connecticut Law Tribune’s “New Leaders in the Law” 2012 which was published in a special New Leaders in the Law yearbook published by the Law Tribune. The award seeks to honor individuals whose achievements distinguish them from their peers.

Mr. Thomen has been recognized as a Connecticut Rising Star in 2012 in Connecticut Super Lawyers magazine, its listing of top lawyers in the Connecticut as selected by peer recognition and professional achievement.
