Dan is a partner in the Intellectual Property/Information Technology and Business Litigation groups at McCarter & English, LLP.  His practice focuses on intellectual property litigation and other complex litigation, as well as pre-litigation counseling.  Dan also serves as Delaware counsel for several major law firms when they need the experience of a Delaware attorney.  Dan practices in all Delaware courts and has substantial trial and courtroom experience.

Past and present representations include:

  • Representing the defendant in a breach of contract and alleged misappropriation of trade secrets dispute;
  • Representing the stockholders’ representative in a post-acquisition indemnification dispute;
  • Representing the defendants in class action antitrust litigation and follow-on state attorney general litigation;
  • Representing defendants in a two-week jury trial in which the jury found for Dan’s clients on all issues;
  • Representing clients as plaintiffs and defendants in patent infringement litigation;
  • Representing innovator clients as plaintiffs in Hatch-Waxman litigation and BPCIA litigation against generic/biosimilar applicants;
  • Representing and counseling investors in Delaware limited liability companies regarding their rights and obligations;
  • Representing a stockholder in successfully challenging and invalidating a provision requiring stockholders to personally indemnify the buyer in a merger transaction; and
  • Representing indigent clients pro bono in family law and other civil disputes.

Dan has been recognized by Chambers USA for 2018. He was also named to the Delaware Business Times “DBT40 2015,” a list of Delaware professionals under the age of 40 who are making a difference across the state with their intelligence, initiative and innovation.

Dan recently co-authored the Delaware chapter of A Practitioner's Guide to Class Actions, Second Edition, published by the American Bar Association in 2017.
