David Silvia is an intellectual property attorney with almost two decades of experience in a full spectrum of IP issues, including patents, copyrights, trademarks, trade secrets and IP litigation. Utilizing the experience and knowledge he gained previously as a practicing design engineer, David has prepared and prosecuted hundreds of patent applications in a variety of technology fields, including, electronic control systems, fluid filtration devices, pumps, gas turbine engines, medical devices and computer implemented financial and business systems. He also counsels individual and corporate clients with respect to internal IP policies and procedures, as well as, patent validity, enforceability, freedom-to-operate and infringement matters. Patent litigation comprises a significant portion of David's practice, he assists firm clients with the enforcement of patent rights, with defending clients against accusations of infringement and with the appeal of adverse judgments. David also routinely counsels investors with respect to valuation of a target company’s intellectual property and the financial risks associated with pending patent litigations.

In addition, for several years David, taught Strategic Decisions in Intellectual Property at the University of Connecticut School of Law including classes concerning claim construction techniques, patent foreign filing considerations and litigation pre-filing investigations.

David began his professional career at General Dynamics in Groton, Connecticut where he worked for ten years as a nuclear project engineer in the TRIDENT submarine design program. During that time, he earned his M.S. in mechanical engineering at Rensselaer Polytechnic Institute and was responsible for providing project leadership for system integration and the design and development of mechanical/electrical tooling for use in dismantling nuclear power plants. Additionally, David assisted the corporate General Counsel with preliminary intellectual property evaluations.

Representative Matters

Lead counsel in successful appeal to the Federal Circuit Court of Appeals reversing an enhanced damages order of the district court.
Represented client in appeal to the Federal Circuit Court of Appeals of an adverse claim construction ruling of the district court.
Represented foreign medical device manufacturer against a claim of patent infringement brought in the Northern District of Illinois.
Settled patent infringement lawsuit on behalf of patent holder and assisted client with the licensing of the technology.
Obtained several U.S. patents for helicopter gas turbine engine components.
