Defending Against Claims Of Delay Damages

An equipment manufacturer in the defense and aerospace industry was faced with a $9 million claim for delay damages and other costs by a top contractor involved in a major defense program. Working with Dan Kelly, our client pursued a $6 million counterclaim for changes to contract specifications and the statement of work. The strength of our defense and counterclaim, supported by outside analysts and experts, resulted in a successful negotiation of settlement of all outstanding claims among the awarding authority, the prime contractor, and our client. Litigation was avoided and our client received follow-on work from the prime contractor.
