James H. Donoian has wide-ranging experience in protecting and enforcing Intellectual Property rights. He has counseled clients for more than 25 years on various global Intellectual Property and brand management issues, including: bet-the–company cases, domestic and international enforcement and litigation and global brand strategies.  His focus is on furthering clients’ business objectives by protecting and maximizing their valuable IP assets, including trademarks, trade dress, copyrights, advertising and rights of publicity. He has also handled disputes involving false and misleading advertising claims and rights of publicity for various consumer goods and services companies.

James has fought for and, where necessary, successfully defended, clients in over 25 different U.S. Courts, handling expedited injunction hearings through trials.  He has litigated against clients’ competitors, licensees and distributors, as well as counterfeiters/infringers.  James is responsible for global anti-counterfeiting programs, successfully combining various IP claims and equitable remedies to obtain seizure orders, asset restraints and other novel forms of equitable relief.  These efforts are often concurrent with, and in conjunction with, criminal actions in the U.S. and/or civil or criminal actions in foreign jurisdictions.

James also counsels clients on advertising and marketing issues and licensing and other agreements, as well as manages clients’ international trademark portfolios.

He advises clients in various industries, including fashion and apparel, jewelry, luxury brand goods, consumer products, toys, media and sports/entertainment, food and nutritional products, pharmaceuticals/medical devices, advertising and marketing, and other industrial and commercial markets.  He works with clients to proactively develop and implement domestic and international brand management programs, and to create early comprehensive IP protection for new products covering trademarks, trade dress, copyrights, design patents and utility patents, in advance of product launches, to restrict anticipated copying by competitors and infringers alike.

James is listed among The World’s Leading Trademark Professionals in New York for 2012 to 2019 by World Trademark Review.
