Mr. Cohen is an experienced environmental litigator. He has been actively involved in handling cost recovery litigation pursuant to various federal and state environmental laws. He was lead counsel in the defense of a cost recovery litigation instituted by the United States in which the United States Environmental Protection Agency was prevented from implementing its selected remedies. In a private cost recovery litigation he persuaded the court that contractual terms that did not expressly preclude CERCLA claims could not be utilized to defeat liability for environmental harm. Mr. Cohen has been involved in other substantial environmental matters including Kin-Buc Landfill, Global Landfill, JIS Landfill, Lone Pine Landfill, Higgins Farm and Higgins Disposal Site Landfills, New York City Landfill Litigation, Edgewater Landfill Litigation, PJP Landfill, Jersey City Chromium Litigation, Preco Industries Site, among others. He also represented the subsidiary of a large British manufacturing entity in its disputes with environmental regulators at fifteen sites throughout the United States.

Mr. Cohen also has extensive experience in other complex, multi-party litigation. He has represented numerous companies in toxic tort lawsuits instituted by individuals for personal injuries and property damage occasioned by exposure to hazardous substances. In that capacity he successfully defended one of the first asbestos cases to be tried in New Jersey in the mid 1980s. In addition to asbestos litigation, he has represented clients in defending claims arising from a wide variety of chemicals and hazardous substances.

Mr. Cohen also has extensive experience representing clients in the pursuit of insurance coverage with respect to litigation arising from environmental, toxic tort, product liability, employment, securities, and intellectual property claims. He was lead trial counsel in a landmark decision that permitted punitive damages to be imposed against insurance companies for their failure to provide coverage for environmental claims asserted against their policyholder. Many of these insurance coverage matters involve multiple claims arising in jurisdictions throughout the United States. Mr. Cohen has substantial experience in marshalling all the resources necessary to prosecute such claims. As part of his practice in this area he also counsels clients on insurance issues so that they may attempt to adequately protect themselves from a variety of lawsuits.

Mr. Cohen has vast experience in general business litigation. He was part of a team that prosecuted in Kentucky one of the largest private anti-trust claims in the United States. He has handled intellectual property disputes, federal securities class actions, shareholder litigation, and general contract litigation.

Mr. Cohen received his undergraduate degree from Rutgers College in 1976. He is a 1979 graduate of the University of Baltimore Law School. During law school he served as a judicial intern for the Honorable Edward S. Northrop, the Chief Judge of the United States District Court for Maryland. After law school Mr. Cohen served as a law clerk to the Honorable Charles S. Joelson, both in his capacity as a member of the Appellate Division, New Jersey Superior Court and as the Assignment Judge of the Superior Court of New Jersey. He has authored numerous articles and made presentations at seminars regarding complex litigation, environmental and insurance coverage issues.
