Mary Gabriel is a partner in the Business Litigation group and practices in the federal and state courts of New York and New Jersey as well as in dispute resolution venues. She focuses on commercial and securities litigation, representing clients in complex contractual disputes, breach of fiduciary duty, professional negligence, securities fraud, RICO, antitrust and shareholder oppression actions.

Mary also advises corporate and individual clients in business transactions, providing practical risk assessments and insight drawn from her years of litigation experience, both in private practice and as an Assistant County Counsel for Union County, New Jersey.

Prior to joining McCarter, Mary clerked for the Honorable Vincent LeBlon, Superior Court of New Jersey, Law Division. She is a director and officer of several New Jersey-based non-profit organizations.

Mary has been recognized as a New Jersey Super Lawyers “Rising Star” in Business Litigation for 2011-2018. In 2016, Mary was selected as a New Jersey Law Journal “New Leader of the Bar.” She is fluent in Arabic. Representative Matters

Defended a top national bank against securities fraud claims filed in New Jersey federal court by an investor; secured dismissal of all claims at the pleading stage on a motion to dismiss.
Defended a Swiss investment management firm and its principal in a SEC investigation and civil claims arising from the liquidation of three hedge funds managed by our clients; favorably settled both matters with no admission of wrongdoing by our clients.
Represented a commercial solid waste hauler against Sherman Act claims of predatory pricing and attempted monopolization brought by competitors in the Southern District of New York; secured dismissal of all claims on summary judgment.
