Obtaining Coverage for Litigation Defense Costs

Like many other companies, our client, a testing laboratory, bought liability insurance not only to fund the costs of settlements and judgments, but also to provide a defense against claims. For a series of asbestos claims, our client was afforded neither. Ira Gottlieb rejected the insurers' no-pay position and negotiated a settlement with an insurer (which had substantial defenses), thereby enabling the client to repay past defense costs, while preserving additional insurance coverage.
