Much has been argued about Netflix’s high market share in the streaming business in connection with its potential merger with Warner Bros. Discovery, which critics claim would create an antitrust presumption of illegality in the streaming market. McCarter & English partner and former DOJ antitrust attorney Robin Crauthers spoke with MLex about the arguments Netflix may mount if Warner Bros. Discovery accepts its bid, and potential political ramifications. “This merger will likely face a long antitrust runway, not only because regulators must examine its impact on content creation, consumer streaming, and ad-supported markets, but because this administration places emphasis on whether a combined platform could hold enough market power to shape who gets heard – and who doesn’t,” she said.
