The US Securities and Exchange Commission (SEC), the Federal Trade Commission (FTC) and the US Department of Justice’s (DOJ) Antitrust Division will be able to return quickly to business as usual whenever government funding returns following the shutdown.
McCarter partner and former DOJ antitrust attorney Robin Crauthers spoke with The National Law Journal and noted the FTC and DOJ will be back to full enforcement in a short period of time on the antitrust side.
Robin, who worked at the agency during the 35-day shutdown from Dec. 22, 2018, to Jan. 25, 2019 said, “The last big, long shutdown, we were back running very quickly after it reopened. It was not an experience where we saw some significant delays.”
She noted that it still may take some time for the agencies to ramp up their investigations and litigation.
“I think we could see a couple of weeks before the litigation gets back to full steam ahead,” she added.
