Benjamin Heller focuses his practice on complex commercial litigation and regularly represents companies of all sizes in state and federal courts. His experience includes defending manufacturers of prescription drugs and medical devices, hospitals, commercial airlines, clothing designers, and other entities. Ben also defends companies in federal multidistrict litigations (MDLs) and New Jersey multicounty litigations (MCLs). He has ample experience at the appellate level and has submitted myriad briefs, motions, and petitions to the New Jersey Supreme Court, United States Court of Appeals for the Third Circuit, and other state appellate courts. In addition to his active litigation practice, Ben counsels medical device manufacturers on risk-mitigation strategies, including by legal review of promotional materials, marketing collateral, and other documents intended for healthcare professionals.
Prior to joining McCarter, Ben served as a judicial law clerk to the Honorable Walter F. Timpone, a Justice of the New Jersey Supreme Court. His responsibilities included drafting comprehensive conference memoranda for the Court, editing opinions, and preparing Justice Timpone for oral arguments and certification conferences. Ben also gained experience at another large New Jersey law firm as a corporate and commercial litigation associate.
Ben earned his JD from Seton Hall University School of Law, where he served as Editor-in-Chief of the Seton Hall Law Review, Volume 47. He received his BA from the State University of New York at Binghamton. While in law school, Ben interned for the Honorable Walter Koprowski, Jr., P.J. Ch., and the New Jersey Office of Administrative Law. He was awarded the ABA/BNA Award for Excellence in Health Law and the Best-Written Brief Award in Appellate Advocacy.
Outside of the office, Ben enjoys playing softball, rooting for the New York Yankees, and reading non-fiction memoirs.
