Shannon Humiston is an associate in McCarter’s Bankruptcy & Restructuring group, focusing her practice on creditor rights, bankruptcy and commercial litigation. She represents lenders, financial institutions, secured and unsecured creditors as well as bankruptcy trustees in both state and federal court proceedings. Shannon has experience litigating commercial foreclosure actions and actions to enforce promissory notes and guaranties. She represents secured creditors in various bankruptcy court proceedings, including actions objecting to discharge, actions objecting to the dischargeability of a particular debt, motions to lift the automatic stay, and defense of avoidance actions.

Shannon also assists in the representation of trustees in bankruptcy proceedings, including litigation to avoid and recover fraudulent conveyances and preferential transfers, claim objections, actions challenging the extent and validity of a claim, motions to recover property, “363” sales, private and public auctions, and estate administration.

Prior to joining the firm, Shannon represented a wide variety of parties in all aspects of bankruptcy, including individual and corporate debtors, creditors’ committees, chapter 7 and 11 trustees, chapter 11 fee examiners, directors and officers, landlords, vendors, trade creditors, utility companies, and other secured and unsecured creditors.

Representative Matters

Salt Meadows Homeowners Association—Jury trial victory

Secured a jury verdict in Delaware Superior Court awarding Salt Meadows $12.9 million—the second largest jury verdict in a construction defect litigation in any Delaware federal or state court. The case revolved around damages related to water infiltration at townhomes in Fenwick Island, Delaware, caused by the general contractor’s negligent construction and supervision of construction at the property 15 years ago.

Pro bono client—Eighth Amendment jury trial victory

Secured a victory for an incarcerated man in a case alleging that the client’s Eighth Amendment rights were violated during a sexual assault by a prison guard. After a two-day trial in the District of Delaware, the jury returned a verdict in favor of our client, including an award of punitive damages.
