Mr. Weisman has a national commercial litigation practice, representing corporate policyholders in all types of insurance-related matters including complex coverage disputes, insurance broker disputes, and premium disputes in state and federal courts throughout the United States. Mr. Weisman advises his clients on and litigates a broad range of insurance issues concerning an array of underlying liabilities and first-party losses under a wide variety of insurance policies, including general liability insurance, directors’ and officers’ insurance, errors and omissions insurance, advertising injury and media liability insurance, employment practices liability insurance, management liability insurance, cyber risk insurance and first party property insurance. His guidance also extends to counseling clients on and litigating premium disputes, including retrospective premium disputes, as well as captive-reinsurance disputes.

He has assisted General Electric Company, Ingersoll-Rand Company, Isolatek International, and Formosa Plastics Corporation, U.S.A., among others, in successfully securing insurance recoveries on large losses. He represented and counseled a manufacturer policyholder in connection with a management liability insurance policy dispute arising from the manufacturer’s insurer’s failure to settle an underlying wrongful termination action, which resulted in a multimillion dollar jury verdict against the manufacturer policyholder outside of its policy’s liability limits. Mr. Weisman litigated the manufacturer’s insurance coverage and bad faith claims against the insurer and secured an amicable resolution of the manufacturer’s claims. Mr. Weisman also has counseled clients, including a major New Jersey transportation company and a New Jersey construction supply company, on state insurance regulations concerning premium ratings, premium audits and classifications for workers compensation policies, advocating on their behalf and representing them in arbitrations.

As a natural extension of litigating complex insurance coverage issues, Mr. Weisman is equally adept at, and has handled, an array of complex general commercial disputes. In that regard, he litigated and assisted in trying a multi-million dollar commercial dispute on behalf of Ingersoll-Rand Company.  Mr. Weisman also represents commercial clients in connection with various insurance broker disputes and managing general agency disputes.

Mr. Weisman’s insurance law counseling extends to providing advice on and negotiating insurance and indemnification provision in commercial contracts, as well as providing advice in corporate transactions.  Mr. Weisman’s credentials also extend to providing advice on the scope of his clients’ existing insurance coverage programs relative to their potential risks.

Mr. Weisman, a founding member of the firm’s Cybersecurity Data Privacy Task Force, frequently counsels clients on their cyber risk insurance coverage and is a frequent speaker on cyber risk issues.

As for his pre-trial work, Mr. Weisman actively and regularly engages in expert witness discovery, deposing experts on a variety of technical issues, including accounting matters and accounting guidance (including GAAP and the SEC’s Staff Accounting Bulletins), environmental standards and insurance industry standards/custom and practice, including underwriting, claims handling, and placement of insurance policies.

Drawing on his broad experience, Mr. Weisman counsels clients on regulatory compliance matters, developing internal practices and procedures to address his clients’ compliance needs.

Mr. Weisman is counted among the group of contributing authors to the Handbook of Civil Practice in the Courts of New Jersey. He also authored Individual Protection Crumbles While Sovereignty Reigns: A Comment on Nelson v. Saudi Arabia, 11 Hofstra Lab. L.J. 429 (1994) and a number of articles concerning insurance-related and cybersecurity related matters.
