The United States Court of Appeals for the Third Circuit has reaffirmed a significant and precedent-setting victory for Robert V.A. Harra Jr., the former President and Chief Operating Officer of Wilmington Trust, and his co-defendants. The court rejected the Government’s attempt to overturn the court’s earlier unanimous decision that reversed a criminal jury conviction against our client and the other co-defendants in the first criminal case against a financial institution that received funds from the Troubled Asset Relief Program (TARP) following the 2008 financial crisis.
In its decision, the court held that, given the evidence and the law, “no rational jury” could have found any of the defendants guilty of 16 of the counts against them, and remanded the remaining two counts to the District Court for a new trial.
Harra was represented by McCarter partners Mike Kelly, Steven Wood, and Geoffrey Rosamond. This is the second Third Circuit victory for McCarter in the last two months.
