McCarter & English is pleased to announce that Brett Kahn has rejoined the firm as a partner in its Insurance Recovery, Litigation & Counseling group. Kahn, a commercial litigator with a focus on insurance coverage, will be based in the firm’s Newark office.
Kahn is a returning team member who began his legal career at McCarter & English and spent nearly 15 years at the firm before departing in Jan. 2023. During his time away, he was a partner at Barnes & Thornburg, continuing his representation of policyholders in complex insurance coverage litigation. His practice spans the pharmaceutical, manufacturing, commercial property, construction, and real estate industries where he handles a wide range of policyholder insurance coverage matters under all policy types, including general liability, property and personal liability, directors and officers (D&O), errors and omissions (E&O), employment practices liability insurance, and cyber risk insurance, among others. He also has experience advising those entering and investing into New Jersey’s growing cannabis industry.

Since leaving McCarter two years ago, I have continued to work closely with the firm as co-counsel on several large matters for several clients, including a major pharmaceutical company,” Kahn said. “What my clients and others in my network need now is a broad bench of legal advisors in New Jersey and up and down the East Coast and McCarter has that in spades.”
Kahn has successfully handled multimillion-dollar coverage disputes and other commercial matters throughout the Northeast. He works closely with clients at every stage – from early case assessments to complex negotiations and litigation – to recover insurance proceeds and resolve coverage and other contract-based claims efficiently. He also counsels his clients on their insurance programs.

Kahn received his JD from Rutgers Law School, and his BS, summa cum laude, from the University of Maryland.
