Zack Hadzismajlovic, Head of the Global Trade Group, was interviewed by Tax Notes regarding a recent federal district court challenge to President Trump’s use of the International Emergency Powers Act (IEEPA). “IEEPA requires the declaration of a national emergency, which means there should have been either a single unusual or extraordinary threat or a series of threats prompted by each of the nearly 200 countries that have had tariffs levied against them”, Zack said. However, he said that is not the case. “Nearly every day this administration offers competing justifications for the tariffs,” including that they are necessary to require countries to fairly contribute to global national defense plans, reshore U.S. manufacturing, and replace the federal income tax.”
