A New Jersey federal judge on Tuesday pared claims in a class action alleging some Whirlpool Corp. washing machines were improperly marketed as Energy Star-qualified, saying the class must amend its complaint to specify the actual injuries incurred by the alleged false advertising.
U.S. District Judge Kevin McNulty said the suit doesn’t actually state which specific models of Maytag washing machines are subject to the claims. He said the suit can only proceed if the class files an amended complaint showing which plaintiff purchased each of the models, in addition to proving that the each of the washers weren’t actually energy-efficient.
