Alex Major spoke to Law360 about the Department of Defense’s unsuccessful efforts to attract small businesses and nontraditional contractors, who are often driven away by inflexible policies, slow contracting processes, and the sheer number of regulations potential contractors have to comply with. “Even the [companies] that are willing to be government contractors and recognize the compliance implications are still confronted with challenging, difficult, confusing, unclear regulations,” he notes. “And the risk-benefit analysis just doesn’t work for them, period.”
