McCarter Team Files Amicus Brief on Behalf of NJ Business Trade Associations Contending that Federal Arbitration Act Preempts State Laws – Skuse v. Pfizer

On behalf of the New Jersey Business and Industry Association, the New Jersey Chamber of Commerce, and the Commerce and Industry Association of New Jersey, McCarter lawyers David Kott, Edward Fanning, Jr., and Steve Del Mauro co-authored a New Jersey Supreme Court amicus brief in Skuse v. Pfizer on the enforceability of an arbitration provision in an employment contract. The amicus brief argued that the Federal Arbitration Act preempts any state law that requires a manifestation of the employee’s intent to arbitrate to be in a form not required in other types of contracts.
