Attorneys for New Castle County have asked a judge to dismiss a wrongful termination lawsuit filed by former Chief Administrative Officer David Grimaldi saying he isn’t entitled $23,000 in back pay.
Grimaldi was fired in October and is suing County Executive Thomas P. Gordon and the county seeking severance and unspecified damages.
The county’s response was filed this week and says that Grimaldi has no standing for severance pay. It also states Grimaldi’s claims for whistleblower protection have no merit because Gordon has full authority over the hiring and termination of his second-in-charge.
Michael Kelly, Gordon’s attorney, did not immediately return a call seeking comment. New Castle County officials declined comment.
