Rethinking the Subcontract Form: Getting to an Agreement That Is Commercially Reasonable and Fair to Both the Prime and Sub
In this interactive session, we will toss out the form subcontracts occupying our websites and e-folders and work together to examine anew language necessary to protect both parties without overreach and unacceptable risk. We’ll start with your views on what terms and conditions should be included and by the end, reach the goal of peace, harmony and love between primes and subs.

Other Transaction Authority (OTA) Roundtable
Other Transaction Authority (OTA) is the term commonly used to refer to the (10 U.S.C. 2371b) authority of the Department of Defense (DoD) to carry out certain prototype projects. Pursuant to the 2016 National Defense Authorization Act (NDAA) Section 845, the DoD currently has permanent authority to award “Other Transactions” (OT) (10 U.S.C. 2371) in certain circumstances for prototype projects that are directly relevant to weapons or weapon systems proposed to be acquired or developed by the DoD. OTs may be used for basic, applied, advanced research and prototype projects when it has been determined that it is in the Government’s best interest to enter into an agreement that is not a contract, grant or cooperative agreement. In this session, we’ll explore the variety of OT vehicles used by various agencies and military departments within DoD and the similarities and differences with FAR-based procurements, and address special issues of concern to OT participants. We will conclude with a panel discussion.

Requests for Equitable Adjustments (REAs) and Certified Claims for Government Contractors
This session will provide contractors with an overview of the differences and similarities between REAs and Certified Claims in US federal government contracting. The course will include discussion of the strategies and contents of each and an overview of the processes and the Contract Disputes Act.
