Kate Buck spoke with Bloomberg Law concerning the impact of the NCAA’s recent litigation settlement designed to antitrust claims brought by athletes related to pay concerning their name, image and likeness. “The unavoidable fact is that antitrust claims will remain an issue absent a settlement negotiated through a formal collective bargaining process or with otherwise sufficient representation of the various constituencies,” said Kate. With the settlement still giving the NCAA power to restrain athlete compensation, there is potential for future lawsuits to challenge these pay limits.
