The New Jersey Supreme Court rendered an opinion in In the Matter of Proposed Construction of Compressor Station on August 6, 2024, adopting McCarter’s position that under the New Jersey Highlands Act routine maintenance and operations by public utilities are exempt from the Highlands Act. McCarter partner David Kott presented oral argument on behalf of the New Jersey Business and Industry Association. David Kott and Leroy Foster wrote the brief.
