Robert Mintz is quoted in Law360 on a recent decision from the Third Circuit that upheld seven wire fraud and conspiracy counts but dismissed two civil rights-related convictions against William E. Baroni Jr. and Bridget Anne Kelly, the former Port Authority of New York and New Jersey executive and former Governor Christie aide who were sentenced to prison for their roles in the “Bridgegate” prosecution.
Robert noted that while the decision “could help the defense if anything occurred between the original sentencing and the new sentencing hearing, and it gives the defense the chance to highlight any sign of rehabilitation or good works taken by the defendants that the judge might view favorably,” the duo is likely to face some jail time since the bulk of the government’s case was affirmed. “Given this result on appeal, and the high-profile nature of this prosecution, the judge may shave a few months off each defendant’s sentence, but it is unlikely that we will see a major reduction in their sentences,” he concluded.
