The US Supreme Court’s decision in Monsanto v. Durnell held that the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) expressly preempts state law failure-to-warn claims that would require a cancer warning on Roundup product labels, reversing a lower court’s judgement.
At the 2026 Asbestos Litigation Conference presented by the New Jersey State Bar Association, McCarter & English partner John Garde joined panelists for “SCOTUS Preemption Decision in Monsanto v. Durnell – Impacts beyond RoundUp?” John and fellow speakers explored the Court’s ruling and examined its potential implications for product liability and preemption litigation beyond the Roundup context.
John also participated in “Overview of Rule 104 Hearings: What Is the Goal and How Do We Get There?” exploring the objectives of Rule 104 hearings and strategies for navigating expert testimony challenges.
