Jane Warren authors an article for the CT Business and Industry Association on the new regulations that are set to replace the decades-old CT Transfer Act on March 1, 2026. The new regulations call for addressing contamination based on when property owners discover new or historic releases, independent of potential property transfers. The regulations are designed to address some of the criticism lobbed at the Transfer Act, though some issues will need to be addressed once the regulations are put into practice. Those issues will continue to be ironed out by the Connecticut Department of Energy and Environmental Protection (DEEP) in quarterly consultation with the working group that has been advising DEEP during the 4-year drafting process.
