In the second half of 2026, several white-collar and commercial cases are drawing the attention of business litigators across Massachusetts.
Dean Elwell spoke with Law360 about the proposed class action against the Red Sox and how the case could provide insight into alleged unfair and deceptive pricing practices.
“If the case goes forward in court, the public could learn quite a bit about the origins of the pricing mechanisms at issue,” he said.
Dean also noted that because the buyers sued under Massachusetts consumer protection laws and their Rhode Island equivalent, if the case stays in federal court, discovery is likely to “explore broad concepts like alleged ‘unfairness’ and ‘deception’ within the organizations’ sales and marketing departments.”
