Explaining the transition to federal court, Zach He noted that federal law prohibits creating sexual visual depictions of anyone under age 18, regardless of specific state age-of-consent laws. “So right now, the state charges have been dropped that he’s charged in federal court with travel and interstate commerce to engage in unlawful sexual contact with a child, as well as with child exploitation,” Zach said. “Now, even though the victim here was 17 under federal law, creating visual depictions that are sexual in nature of someone under 18 of a child is a violation of federal law.”
