Secured a motion to dismiss a putative class action lawsuit in the Southern District of New York against a movie theatre chain. Plaintiff alleged that our client disclosed consumers’ personally identifiable information related to his movie viewing history to Facebook in violation of the Video Privacy Protection Act (VPPA). The court agreed with our argument that the alleged disclosure of information cited by Plaintiff does not constitute “personally identifiable information” within the meaning of the VPPA and pursuant to recent binding precedent in the Second Circuit. The court granted our motion and dismissed the case with prejudice.
