The defendant, a neighbor, made improvements to their backyard that resulted in the construction of a retaining wall intruding on our client's property, prompting a suit for its removal. After a two-day bench trial, the court excluded the defendant’s expert testimony and issued a judgment ordering the removal of the wall and other encroachments within 90 days.
