Represented USMR in a prerogative writs trial in the Superior Court of New Jersey that resulted in invalidating the resolutions by the Borough of Carteret that had declared USMR’s 50-acre, former industrial site as an area in need of redevelopment. During the trial, we successfully barred two of the Borough’s proffered expert witnesses from testifying and discredited the testimony of their third witness. In addition, working with the assistance of accepted experts in the areas of geotechnical construction and private commercial markets, we were able to show the court that USMR’s past and ongoing site remediation efforts precluded Carteret’s effort to condemn the property.
