Joe Scholz is an experienced trial lawyer who has successfully litigated disputes in federal and state courts and arbitrations for over 25 years. He has represented a number of major financial institutions, Fortune 500 corporations, and business executives at the trial level, and has also won significant appellate victories in the Supreme Court of New Jersey and the New York Court of Appeals.

Throughout his career, a primary focus of Joe’s practice has been trial advocacy. He is a tenacious advocate who has handled matters for corporations and executives across a broad range of industries, including financial services, commodities producers, accounting firms, and pharmaceutical developers. His cases have involved numerous substantive areas of law, including securities, employment, contracts, environmental, fraud investigations, bankruptcy, and intellectual property rights.

He has extensive experience representing financial services companies and derivatives brokers in complex litigation concerning the hiring and firing of brokers, the enforceability of restrictive covenants, and raiding cases.

Inter-dealer broker—FINRA arbitration

Represented CEO and brokers of a leading inter-dealer broker in a FINRA arbitration and related state court proceedings against a rival company concerning brokers of credit derivatives and the impact of the credit crisis on the market.

State of New Jersey—Significant Victory

Represented the State of New Jersey in a litigation against the State of New York that resulted in a significant victory in favor of our client at the New York Court of Appeals, which declared New York’s commuter tax unconstitutional.

Electronics manufacturer—Fraud investigation

Represented global electronics manufacturer in connection with fraud investigation and related litigation brought to recover funds stolen from client.

Telecommunications CEO—Two federal court trials

Represented former CEO of large telecommunications corporation in two federal court trials against another large telecommunications company concerning compensation and other issues, resulting in a substantial jury verdict in favor of our client.

Financial service executives—Contract litigation

Represented executives of large financial services company in contract litigation seeking hundreds of millions of dollars, and obtained dismissal of all claims against clients.

Copper and Gold Producer—Class Action and Environmental Clean Up

Representing one of the world’s largest producers of copper and gold in a complex environmental case in federal court concerning the cleanup of an industrial site in Carteret, NJ that involved federal and state environmental cost recovery statutes.
