Whether or not to create, maintain, or make changes to a DEI policy or program is ultimately a decision each employer should make after conducting a full assessment of the risks and benefits, in the context of the employer’s organizational mission and its legal and contractual obligations. Our team actively tracks state and federal statutes and regulations, pending and threatened litigation or claims, as well as Executive Orders, government agency memoranda, and other enforcement guidance that could affect DEI policies and programs.
