Pam Moore and Emily Gianquinto obtained a favorable negligence ruling and a corresponding damages award from a Connecticut Superior Court Judge for client Catherine M. Ferentini, finding that her prior law firm was negligent in failing to secure its email system at the time Ferentini was tricked into wiring $90,586 to a fraudster based on an email seemingly from her lawyer. In 2018, our client received an email from a Comcast.net domain, appearing to be from her real estate attorney, instructing her financial advisor to wire funds to an account that turned out to be fraudulent. Following a bench trial argued by Emily Gianquinto for Ferentini, Judge Juliett L. Crawford found negligence, noting that evidence showed the prior firm failed to follow its own policies and procedures, despite a similar incident occurring with another client just months prior. Our client was awarded $90,586 in damages plus pretrial interest, and the court may award attorneys’ fees at a future hearing.
