David Kott Argues Case before NJ Supreme Court Weighing Enforceability of Electronic Employee Arbitration Agreement in Pfizer Case

McCarter partner David Kott argued before the New Jersey Supreme Court on behalf of amici curiae New Jersey Business and Industry Association, New Jersey Chamber of Commerce and Commerce and Industry Association of New Jersey in Skuse v Pfizer.  The New Jersey Law Journal quoted portions of David’s argument stating among other things that “the heightened requirement for establishing mutual assent to arbitration that was applied by the Appellate Division violates the Federal Arbitration Act.” The case was also covered in Law360.
