David Kott Argues in the NJ Appellate Division in Medical Device Products Liability Case

On January 25, 2021 David Kott presented oral argument in the New Jersey Appellate Division on behalf of defendant C. R. Bard, Inc. in McGinnis v. Bard.  The primary issues on the appeal were the admissibility of 510(k) evidence and whether punitive damages are recoverable as a matter of law against a medical device manufacturer under the New Jersey Products Liability Act.
