McCarter Team Mentioned in Summary Judgment Win for Multi-National Pharmaceutical Company

Delaware Law Weekly reported on the success of securing summary judgment after the court held that the plaintiff could not establish proximate causation as a matter of law nor could the plaintiff overcome the learned intermediary doctrine.  The court also confirmed that Delaware law does not support a claim against a brand name drug manufacturer for a plaintiff’s use of a generic drug.
