Intellectual Property & Data Rights in Federal Contracting
This presentation will provide an introduction and overview of the statutes, regulations, policies and clauses which govern both the agency’s and the contractor’s rights to intellectual property generated and/or delivered under a government contract. Knowledge in this area is essential for any company, interested in preserving rights to its technology, that accepts, directly or indirectly federal funding – whether under a DoD or civilian agency contract, a SBIR, a CRADA, an OT, a grant, or a subcontract. The presentation will discuss the rules of the road – and importantly – flexibility in those rules allowing for negotiation of an allocation of IP rights that makes sense for both the agency and contractor.
