McCarter Partners to Appear for Amici in New Jersey Supreme Court in NJ Consumer Fraud Class Action

The New Jersey Supreme Court has granted a motion filed by McCarter partners Ed Fanning, Jr. and David Kott to appear as amici curiae on behalf of the New Jersey Business and Industry Association, the New Jersey Chamber of Commerce, and the Commerce and Industry Association of New Jersey in DeSimone v Springpoint.  Ed Fanning will present oral argument that the refund provision of the New Jersey Truth in Menu Act does not apply to all claims asserted under the New Jersey Consumer Fraud Act.
