McCarter secured a victory in the Delaware Court of Chancery on behalf of FANchise League Company, LLC, which owns and operates the Fan Controlled Football League, a professional league combining traditional sports with elements of e-games, social media, and crowdsourcing. The dispute was brought by Alchemy, LTD LLC and involved an alleged breach of contract by FANchise. Among other things, the plaintiff sought specific performance of an option agreement that would have enabled Alchemy to obtain a team in the Fan Controlled Football League. Following oral argument and supplemental briefing, the court granted summary judgment in favor of FANchise and ruled that the option agreement was not enforceable.
