The New Jersey Supreme Court has granted a motion filed by McCarter lawyers Thomas Doherty, Ilana Levin, and David Kott for leave that the New Jersey Business and Industry Association appear as an amicus curiae and present oral argument in an employment law case. Tom will present oral argument that the Wage Theft Act should not be applied retroactively from the date of enactment. The Wage Theft Act includes an amendment of the Wage and Hour Law’s two-year statute of repose to become a six-year statute of repose, so that retroactive application would involve reviving causes of action that had previously expired. In addition, retroactive application of the Wage Theft Act’s new remedies to already-completed conduct would violate due process and result in a manifest injustice to employers.
