The NJ Supreme Court recently issued a ruling that adopted the primary argument that McCarter had made on behalf of Amici Curiae the NJ Business and Industry Association, the NJ Chamber of Commerce and the Commerce and Industry Association of NJ in Skuse v. Pfizer. In its ruling the Supreme Court held that an arbitration agreement that an employee had agreed to electronically was enforceable. McCarter’s brief was authored by David Kott and Edward Fanning, Jr. and David Kott argued the case in the NJ Supreme Court.
