A proposed $4 billion settlement for victims of the 2023 Maui wildfire is in jeopardy as the Hawaii Supreme Court looks into insurers’ rights to recoup payments from those responsible for the fire. Sheri Pastor, chair of our Insurance Recovery, Litigation & Counseling group, spoke to Law360 about the need for a quick court decision to ensure Hawaiian Electric can handle its financial obligations and keep the settlement on track. She warns that because the settlement expires in 9 months, any delays could turn a win for plaintiffs into a “pyrrhic victory,” leaving them without the compensation they need if key defendants can’t meet their financial obligations.
