Sheri Pastor has litigated many of the industry’s most significant and high-stakes coverage disputes, achieving wins that not only resulted in substantial awards but also set precedent, leading to significant advances for corporate policyholder litigants.
Her notable recent achievements include: a $15.6 million jury verdict award for client Wakefern Food Corp. against its insurance consultant for having improperly advised on a property insurance policy; setting precedent with a summary judgment win establishing New Jersey law that “physical damage” in a property and business interruption policy includes loss of use, value, and function; securing summary judgment on behalf of an industrial shelving manufacturer after convincing a federal court that a former employee’s bill padding and kickback scheme was a direct and covered loss under the client’s crime insurance policy; and achieving a complete victory on behalf of Transamerica Corporation in a dispute with a former subsidiary regarding $1.5 billion in coverage – following a six-month trial, the court found Transamerica’s risk management department was not its subsidiaries’ “de facto insurer,” and that its former subsidiaries were liable for their own asbestos losses.
In addition to her work as a litigator, Sheri regularly provides insurance coverage advice to clients, assessing their potential risks, analyzing new insurance products, considering the adequacy of their programs, and advising on insurance issues related to corporate transactions.
Sheri is the Immediate Past President of the American College of Coverage Counsel (ACCC). She also is the Past Chair (Policyholder Side) of the ABA Litigation Section’s Insurance Coverage Litigation Committee (ICLC), having served as Vice-Chair from 2009-2012 and as co-chair of various ICLC subcommittees since 2002. She was a member of the New Jersey Supreme Court’s Professional Responsibility Rules Committee for over a decade and a member of the New Jersey Supreme Court’s Working Group on Ethical Issues Involving Metadata in Electronic Documents. She also serves as an Editorial Consultant to Law360: Insurance and was on the Editorial Boards of the Insurance Coverage Law Bulletin and a consultant on the New Appleman Insurance Law Practice Guide.
