Represented and extricated client DCO Energy’s subsidiary Energy Center Dover LLC from a messy alleged air permit violation issued by the Delaware Department of Natural Resources and Environmental Control. The Department alleged violations of averages of NOx and CO2 emissions limits over the course of months. Resolution involved payment of a reduced fine, a mutually acceptable environmental improvement project and, crucially, agreement that there was “no admission of law or fact”.
