Secured a win for Ethos Veterinary Health, LLC before the Massachusetts Workers’ Compensation Rating and Inspection Bureau’s (“WCRIBMA”) Appeals Committee. Ethos challenged the propriety of its insurer calculating workers’ compensation premiums based, in part, on Ethos’ one time change-in-control payments made to its employees. The WCRIBMA confirmed the insurer should not have included these payments in its premium calculations, and the insurer appealed. After argument and limited discovery, the Appeals Committee affirmed the WCRIBMA’s ruling.
