Specialty pharmaceutical manufacturer—Summary judgment granted

Along with co-counsel, secured summary judgment on behalf of a specialty pharmaceutical manufacturer in a post-closing milestone payment dispute arising from the sale of a pharmaceutical portfolio for $300 million upfront and up to $230 million in contingent payments. The Delaware Superior Court's Complex Commercial Litigation Division held that the agreement unambiguously required payment of the earned milestone and awarded our client the full withheld amount, attorneys' fees, costs, and contractual pre- and post-judgment interest.
